三、 報酬及其他福利

乙方在試用期期間的報酬為稅前5000元/月，大寫 :伍仟元

試用期過后，甲方將每月利潤的2%作為分紅支付給乙方,直到乙方離職。

3.2 甲方應于每月8號以貨幣或轉(zhuǎn)帳形式足額支付乙方上述報酬。如遇節(jié)假日或休息日，應提前到最近的工作日支付，如因特殊原因延期支付報酬的，甲方應在五個工作日內(nèi)向乙方說明原因。
Party A shall pay salary to Party B before the 8th day of every month in the form of cash or bank-transfer. If the 8th day of the month falls in the weekend or holiday, the payment shall be brought forward to the nearest weekday. Party A shall inform Party B and explain the detailed reason within 5 work days in case Party A fails to pay the salary due to special reasons.
3.3 甲方可根據(jù)生產(chǎn)經(jīng)營的狀況或乙方任務量和工作表現(xiàn)，適時調(diào)整乙方的報酬。
Party A can adjust Party B’s salary according to its operating conditions, Party B’s workload and performance.
3.4 當乙方的工作任務發(fā)生變化時，甲方可按規(guī)定調(diào)整其相應的報酬。乙方接受新的工作任務后，即視作接受甲方按照該工作任務重新確定的報酬。
Party B’s labor remuneration will be adjusted in case Party A adjusts Party B’s job responsibilities. Accepting thenew position is regarded as accepting the adjusted salary.
3.5 乙方應遵守國家及地方的稅法制度，自行繳納其個人收入的個人所得稅，甲方無義務為其代繳。
Party B shall pay personal income tax voluntarily according to the state’s tax law. Party A doesn’t shoulder the responsibility to withhold and remit taxes for Party B.
3.6若病假連續(xù)超過三天，公司支付三天基本工資的一半。超過三天的部分則按現(xiàn)行照法定病金支付。若病假持續(xù)，符合社會保障部法定病金的相關規(guī)定，則從病假的第一天起，公司只支付法定病金，所有的病假都應有醫(yī)學證明。
Party B sick leave exceeds three days in one continuous period the Employer will pay at half your basic rate the first three days. Thereafter pay will be at the current rate of Statutory Sick Pay. Where periods of incapacity are linked, as laid down in DSS Statutory Sick Pay regulations, you will only receive Statutory Sick Pay at the current rate from the first day of incapacity.All leave due to sickness must be supported by a bona fide medical certificate.
四、 雇傭合同的解除和終止
?、鬋ontract Cancellation and Termination
4.1 合同期滿雙方不再續(xù)簽或者雙方約定的合同終止條件出現(xiàn)時，雇傭合同即終止。
This contract shall be terminated once it expires and both parties do not extend the contract.
4.2 經(jīng)合同雙方當事人協(xié)商一致，本合同可以解除。
The contract may be canceled based on both parties’ mutual negotiation.
4.3 乙方應遵守中國的法律、法規(guī)及有關規(guī)定，乙方如違反上述規(guī)定，甲方有權即時解除合同；乙方因健康原因，經(jīng)醫(yī)生證明連續(xù)病休15工作日后仍不能繼續(xù)工作，甲方有權提前終止合同。
Party B should abide by China laws, decrees and related regulations and Party A’s working systems. During the duration, Party A is entitled to cancel the contract in case Party B violates China laws and decrees, and terminate the contract before expiration in case Party B cannotresume his or her work for health reasons after the medical certification of continuous sick rest for 15 working days.
4.4 乙方因歸國或其他私人原因未正常出勤且超過十天且未向甲方做出書面說明的，本合同自動終止。 The contract will automatically terminate in case Party B is absent for over 10 days without written explanation due to homecoming or other private reasons.
4.5 乙方被證明無法完成本合同項下的工作任務，甲方有權隨時解除本合同。

4.6 乙方應嚴格遵守甲方的工作規(guī)定以及規(guī)章制度，盡職盡責，否則，甲方有權隨時解除合同并追究因此而造成的經(jīng)濟損失，并有權對所造成的經(jīng)濟損失在乙方的報酬中作相應扣除。

五、 保證金 Deposit
1. 為確保房屋及其附屬設施之安全與完好，及租賃期內(nèi)相關費用之如期結算，乙方同意于______年_____月_____日前支付給甲方保證金人民幣 _________元整，甲方在收到保證金后予以書面簽收。

3. 因乙方違反本合同的規(guī)定而產(chǎn)生的違約金、損壞賠償金和其它相關費用，甲方可在保證金中抵扣，不足部分乙方必須在接到甲方付款通知后十日內(nèi)補足。
In case party B breaches this contract, party A has right to deduct the default fine, compensation for damage or any other expenses from the deposit . In case the deposit is not sufficient to cover such items, Party B should pay the insufficiency within ten days after receiving the written notice of payment from Party A.
六、 甲方義務 Obligations of Party A
1. 甲方須按時將房屋及附屬設施(詳見附件)交付乙方使用。
Party A will provide the premises and attached facilities (see the appendix of furniture list for detail) on schedule to Party B for using.
2. 房屋設施如因質(zhì)量原因、自然損耗或災害而受到損壞，甲方有修繕并承擔相關費用的責任。
In case the premise and attached facilities are damaged by quality problems, natural damages or disasters, Party A will be responsible to repair and pay the relevant expenses.
3. 甲方應確保出租的房屋享有出租的權利，反之如乙方權益因此遭受損害，甲方應負賠償責任。
Party A will guarantee the lease right of the premises. Otherwise, Party A will be responsible to compensate Party B's losses.
七、 乙方義務 Obligations of Party B
1. 乙方應按合同的規(guī)定按時支付定金、租金及保證金。
Party B will pay the rental, the deposit and other expenses on time.
2. 乙方經(jīng)甲方同意，可在房屋內(nèi)添置設備。租賃期滿后，乙方將添置的設備搬走，并保證不影響房屋的完好及正常使用。
Party B may decorate the premises and add new facilities with Party A's approval. When this contract expires, Party B may take away the added facilities which are removable without changing the good conditions of the premises for normal use.
3. 未經(jīng)甲方同意，乙方不得將承租的房屋轉(zhuǎn)租或分租，并愛護使用該房屋如因乙方過失或過錯致使房屋及設施受損，乙方應承擔賠償責任。
Party B will not transfer the lease of the premises or sublet it without Party A's approval and should take good care of the premises. Otherwise, Party B will be responsible to compensate any damages of the premises and attached facilities caused by its fault and negligence.
4. 乙方應按本合同規(guī)定合法使用該房屋，不得擅自改變使用性質(zhì)。乙方不得在該房屋內(nèi)存放危險物品。否則，如該房屋及附屬設施因此受損，乙方應承擔全部責任。
Party B will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials in it. Otherwise, Party B will be responsible for the damages caused by it
5. 乙方應承擔租賃期內(nèi)的水、電、煤氣、電訊、收視費、等一切因?qū)嶋H使用而產(chǎn)生的.費用，并按單如期繳納。
Party B will bear the cost of utilities such as communications, water, electricity, gas, management fee etc. on time during the lease term.
八、 合同終止及解除的規(guī)定 Termination and dissolution of the contract
1. 乙方在租賃期滿后如需退租或續(xù)租，應提前兩個月通知甲方，由雙方另行協(xié)商退租或續(xù)租事宜。在同等條件下乙方享有優(yōu)先續(xù)租權。
Within two months before the contract expires, Party B will notify Party A if it intends to extend the leasehold. In this situation, two parties will discuss matters over the extension.
2. 租賃期滿后，乙方應在當天將房屋交還甲方;任何滯留物，如未取得甲方諒解，均視為放棄，任憑甲方處置，乙方?jīng)Q無異議。
When the lease term expires, Party B will return the premises and attached facilities to Party A within days. Any belongings left in it without Party A's previous understanding will be deemed to be abandoned by Party B. In this situation, Party A has the right to dispose of it and Party A will raise no objection.
3. 本合同一經(jīng)雙方簽字后立即生效;未經(jīng)雙方同意，不得任意終止，如有未盡事宜，甲、乙雙方可另行協(xié)商。

九、 違約及處理 Breach of the contract
1. 甲、乙雙方任何一方在未征得對方諒解的情況下，不履行本合同規(guī)定條款，導致本合同中途中止，則視為該方違約，雙方同意違約金為人民幣___________元整，若違約金不足彌補無過錯方之損失，則違約方還需就不足部分支付賠償金。
During the lease term, any party who fails to fulfill any article of this contract without the other party's understanding will be deemed to breach the contract. 八、爭議的解決：

代理商將根據(jù)此協(xié)議獲得等同于[媒體傭金費率]的由代理商投放廣告媒體所征收的總費用；并且在總量折扣之后獲得等同于[非媒體傭金費率]的供應商的服務或財產(chǎn)的費用，如藝術品，總體設計，字體組合，福圖斯斯文文仄直接影印本，版畫，印刷，廣播和電視節(jié)目，人才，文學作品，戲劇和音樂作品，唱片和展覽，由代理商根據(jù)廣告商的授權在此協(xié)議期限內(nèi)購買；只要：
(i) No percentage will be added to Agency charges for packing, shipping, express, postage, telephone, telex, fax, travel expenses and other out of pocket expenses of Agency personnel; and
沒有任何費用加在代理商用于以下項目的費用上：如包裝，運輸，快遞，郵費，電話，電傳，傳真，旅行費用和出于代理商人員的其它費用；并且
(ii)Agency’s commisssion for outdoor advertising will be the standard rate allowed advertising agencies when such rate is less than
