三類(lèi)非典型用工模式所涉法律風(fēng)險(xiǎn)及其緩釋措施
目前,我國(guó)《勞動(dòng)合同法》就全日制勞動(dòng)合同用工下的勞動(dòng)合同簽訂、解除等方面進(jìn)行了明確規(guī)定,但在實(shí)踐中,除全日制勞動(dòng)合同用工的企業(yè)基本用工模式之外,為生產(chǎn)經(jīng)營(yíng)所需,企業(yè)還廣泛存在著非全日制用工模式、退休返聘用工模式及雙重勞動(dòng)關(guān)系下用工模式等三類(lèi)非典型用工模式。為優(yōu)化企業(yè)人力資源配置和員工結(jié)構(gòu),避免企業(yè)用工風(fēng)險(xiǎn),保障和維護(hù)勞資雙方的合法權(quán)益,本文將分別從三類(lèi)非典型用工模式的概念、法律風(fēng)險(xiǎn)及其緩釋措施進(jìn)行分析。
一、非全日制用工是與全日制工作相對(duì)稱(chēng)的,在典型的勞動(dòng)用工模式下,以每天8小時(shí)的全日制工作時(shí)間為常態(tài),然而由于受到經(jīng)濟(jì)不景氣、就業(yè)壓力增大、就業(yè)觀念轉(zhuǎn)變等諸多因素影響,非全日制用工逐漸成為企業(yè)的一種重要用工模式。相比于全日制工作,非全日制用工具有勞動(dòng)時(shí)間上的靈活性,對(duì)于企業(yè)而言,可以根據(jù)市場(chǎng)變化適時(shí)調(diào)整勞動(dòng)力余缺,節(jié)省人力成本的支出;對(duì)于勞動(dòng)者而言,可以享受更大的時(shí)間自由度,解決職家沖突。
根據(jù)我國(guó)《勞動(dòng)合同法》第五章第三節(jié)關(guān)于非全日制用工的規(guī)定,非全日制用工的界定標(biāo)準(zhǔn)為:以小時(shí)計(jì)酬為主,勞動(dòng)者在同一用人單位平均每日工作時(shí)間不超過(guò)4小時(shí),每周工作時(shí)間累計(jì)不超過(guò)24小時(shí)。為體現(xiàn)非全日制用工的特殊性和靈活性,我國(guó)《勞動(dòng)合同法》規(guī)定,用人單位與勞動(dòng)者無(wú)需簽訂書(shū)面勞動(dòng)合同,不能約定試用期,可隨時(shí)終止用工關(guān)系,工資結(jié)算周期不超過(guò)15天。
(二)非全日制用工存在的法律風(fēng)險(xiǎn)
1、被認(rèn)定為全日制用工導(dǎo)致的法律風(fēng)險(xiǎn)
由于我國(guó)《勞動(dòng)合同法》僅從日、周工作時(shí)間范圍標(biāo)準(zhǔn)對(duì)非全日制與全日制兩種用工模式進(jìn)行界定,該標(biāo)準(zhǔn)雖然從字面意義角度明確清晰,但在實(shí)際操作過(guò)程中卻存在諸多問(wèn)題,繼而引發(fā)用人單位的用工風(fēng)險(xiǎn),其中最大的風(fēng)險(xiǎn)為非全日制用工方式被認(rèn)定為全日制用工,主要誘因包括:因“加班”等原因?qū)е氯?、周工作時(shí)間超過(guò)了法定時(shí)限;未訂立非全日制用工書(shū)面協(xié)議且缺乏考勤記錄導(dǎo)致無(wú)法證明日、周的實(shí)際工作時(shí)間等。
若非全日制用工被認(rèn)定為全日制用工,則用人單位應(yīng)按照全日制用工的相關(guān)規(guī)定履行用人單位義務(wù)并承擔(dān)相應(yīng)責(zé)任,包括但不限于:應(yīng)簽訂書(shū)面勞動(dòng)合同,否則將承擔(dān)雙倍工資的支付責(zé)任;不得隨意解除勞動(dòng)關(guān)系,否則將承擔(dān)支付經(jīng)濟(jì)補(bǔ)償金、賠償金的責(zé)任。
2、被認(rèn)定為勞務(wù)關(guān)系導(dǎo)致的法律風(fēng)險(xiǎn) 非全日制用工
(一)非全日制用工概述
由于未簽訂書(shū)面非全日制用工書(shū)面協(xié)議或未依法購(gòu)買(mǎi)工傷保險(xiǎn)等原因,導(dǎo)致非全日制用工被認(rèn)定為勞動(dòng)關(guān)系或雇傭關(guān)系。若在用工期間,勞務(wù)提供者發(fā)生人身意外,企業(yè)需要依據(jù)《中華人民共和國(guó)侵權(quán)責(zé)任法》及《最高人民法院關(guān)于審理人身?yè)p害賠償案件適用法律若干問(wèn)題的解釋》等相關(guān)規(guī)定承擔(dān)人身?yè)p害賠償責(zé)任,由于此人身?yè)p害賠償責(zé)任較之工傷賠償責(zé)任更重,且無(wú)法通過(guò)工傷保險(xiǎn)方式將賠付風(fēng)險(xiǎn)予以合法分散,因此,此類(lèi)法律風(fēng)險(xiǎn)較高。
3、未購(gòu)買(mǎi)工傷保險(xiǎn)導(dǎo)致的工傷賠付風(fēng)險(xiǎn)
雖然相關(guān)法律法規(guī)并未要求非全日制用工簽訂書(shū)面勞動(dòng)合同,但非全日制用工下的勞資雙方仍屬于勞動(dòng)關(guān)系,用人單位具有為勞動(dòng)者繳納社會(huì)保險(xiǎn)的法定義務(wù)?;诜侨罩朴霉と藛T流動(dòng)性大、人員增減調(diào)整方便,許多單位未將非全日制勞動(dòng)者納入單位人力資源庫(kù),相應(yīng)的社會(huì)保險(xiǎn)購(gòu)買(mǎi)義務(wù)也容易被忽視,同時(shí),部分勞動(dòng)者也為多獲得現(xiàn)金而要求用人單位不購(gòu)買(mǎi)社會(huì)保險(xiǎn),由此導(dǎo)致用人單位未為非全日制勞動(dòng)者購(gòu)買(mǎi)社會(huì)保險(xiǎn)的情形大量存在。
若用人單位未為勞動(dòng)者購(gòu)買(mǎi)社會(huì)保險(xiǎn),尤其是工傷保險(xiǎn),則一旦勞動(dòng)者發(fā)生工傷事故,用人單位須按照《工傷保險(xiǎn)條例》等規(guī)定的標(biāo)準(zhǔn)向工傷者支付相應(yīng)工傷保險(xiǎn)待遇。
(三)非全日制用工風(fēng)險(xiǎn)的緩釋措施
1、簽訂書(shū)面協(xié)議,購(gòu)買(mǎi)社保
由于非全日制用工下的勞動(dòng)條件與勞動(dòng)者個(gè)別情況相對(duì)應(yīng),自身呈現(xiàn)多樣化,因此,非全日制用工比全日制用工更容易產(chǎn)生混亂和紛爭(zhēng),為了避免紛爭(zhēng),通過(guò)書(shū)面形式明確勞動(dòng)條件較全時(shí)勞動(dòng)關(guān)系更加必要。同時(shí),用人單位與勞動(dòng)者所簽訂的勞動(dòng)合同可區(qū)別于全日制用工性質(zhì)、區(qū)別于被認(rèn)定為民法意義上的勞務(wù)關(guān)系,為確定非全日制用工的最好證明,對(duì)用人單位而言有著減小用工風(fēng)險(xiǎn)的作用。非全日制勞動(dòng)合同的內(nèi)容由雙方協(xié)商確定,但至少應(yīng)當(dāng)包括工作時(shí)間和期限、工作內(nèi)容、勞動(dòng)報(bào)酬、勞動(dòng)保護(hù)和勞動(dòng)條件五項(xiàng)必備條款,但不得約定試用期。
由于為非全日制員工購(gòu)買(mǎi)社會(huì)保險(xiǎn)可有效分散工傷賠償風(fēng)險(xiǎn)同時(shí)也是區(qū)別于勞務(wù)關(guān)系及全日制勞動(dòng)關(guān)系的重要標(biāo)志,再加之,用人單位所承擔(dān)的社會(huì)保險(xiǎn)費(fèi)用并不高,因此,為非全日制員工購(gòu)買(mǎi)社會(huì)保險(xiǎn)可有效防范對(duì)外承擔(dān)工傷賠付或人身?yè)p害賠付的風(fēng)險(xiǎn)。
2、加強(qiáng)用工管理,規(guī)避利益沖突
在做好簽訂書(shū)面協(xié)議、購(gòu)買(mǎi)社保基礎(chǔ)上,用人單位還應(yīng)做好用工管理,具體包括:(1)做好非全日制勞動(dòng)者的考勤管理工作,通過(guò)考勤機(jī)制關(guān)于工作時(shí)間等信息的記錄進(jìn)一步佐證非全日制用工性質(zhì);(2)避免出現(xiàn)諸如“加班”等事由導(dǎo)致非全日制勞動(dòng)者工作時(shí)間超過(guò)法定時(shí)限情形;(3)在涉及商業(yè)秘密領(lǐng)域避免使用非全日制用工模式,若確需使用,則應(yīng)簽訂書(shū)面的保密協(xié)議。
二、退休返聘
(一)退休返聘概述
退休返聘,系指已達(dá)或超過(guò)法定退休年齡,或者是因自愿或經(jīng)單位同意同原單位辦理退休手續(xù)的人員,通過(guò)簽訂協(xié)議或以事實(shí)工作方式而繼續(xù)帶薪工作。退休返聘主要包括三種表現(xiàn)形式:
1、辦理退休手續(xù)后,又繼續(xù)延長(zhǎng)在原工作崗位的工作時(shí)間;
2、辦理退休手續(xù)后,又應(yīng)聘或受聘回原單位工作從事同類(lèi)或不同類(lèi)的工作;
3、辦理退休手續(xù)后,在勞務(wù)市場(chǎng)擇業(yè),被應(yīng)聘到單位工作的情形。
目前,我國(guó)對(duì)退休返聘有較為明確規(guī)定的兩個(gè)規(guī)范性文件為《關(guān)于實(shí)行勞動(dòng)合同制度若干問(wèn)題的通知》和《〈關(guān)于對(duì)實(shí)行勞動(dòng)合同制度若干問(wèn)題的請(qǐng)示〉的復(fù)函》,但效力層級(jí)較低且內(nèi)容僅涉及協(xié)議簽訂、解除、爭(zhēng)議受理等,未明確規(guī)定退休反聘屬于勞動(dòng)關(guān)系還是勞務(wù)(雇傭)關(guān)系,但在實(shí)踐操作中,大部分的司法機(jī)關(guān)根據(jù)退休人員不符合《勞動(dòng)合同法》等相關(guān)規(guī)定的勞動(dòng)者主體資格,一般將退休返聘視為勞務(wù)關(guān)系,受《民法通則》、《合同法》等民事法律法規(guī)的調(diào)整,而不適用《勞動(dòng)合同法》等規(guī)定。另外,諸如上海地區(qū)也將退休返聘作為“特殊勞動(dòng)關(guān)系”予以處理,仍適用于勞動(dòng)條件、最低工資標(biāo)準(zhǔn)的規(guī)定。
(二)退休返聘存在的法律風(fēng)險(xiǎn)
1、被認(rèn)定為勞動(dòng)關(guān)系導(dǎo)致的風(fēng)險(xiǎn)
若退休人員尚未達(dá)到法定退休年齡,但已在用人單位辦理了內(nèi)退手續(xù),再由用人單位返聘工作的,退休人員與用人單位之間形成的用工關(guān)系應(yīng)按勞動(dòng)關(guān)系處理。若用人單位基于其退休人員身份而未與之簽訂勞動(dòng)合同、購(gòu)買(mǎi)社會(huì)保險(xiǎn)等,則存在用人單位需支付雙倍工資、工傷賠償?shù)戎卮蠓娠L(fēng)險(xiǎn)。
2、人身?yè)p害賠償?shù)娘L(fēng)險(xiǎn)
若退休人員在工作過(guò)程中受到人身傷害的時(shí)候,用人單位仍然要對(duì)退休人員承擔(dān)雇主的賠償責(zé)任,具體而言,應(yīng)按照《最高人民法院關(guān)于審理人身?yè)p害賠償案件適用法律若干問(wèn)題的解釋》的具體標(biāo)準(zhǔn)并結(jié)合雙方的過(guò)錯(cuò)程度向退休人員給予賠付。
(三)退休返聘法律風(fēng)險(xiǎn)的緩釋措施
1、做好身份審查工作
在返聘錄用之前,用人單位應(yīng)對(duì)返聘者是否達(dá)到退休年齡及是否開(kāi)始享受養(yǎng)老待遇進(jìn)行盡職調(diào)查,避免雙方形成事實(shí)勞動(dòng)關(guān)系的被動(dòng)局面,若對(duì)方未達(dá)到退休年齡,則用人單位應(yīng)與之簽訂書(shū)面勞動(dòng)合同并購(gòu)買(mǎi)相應(yīng)的社會(huì)保險(xiǎn)。
2、簽訂書(shū)面協(xié)議,明確雙方權(quán)利義務(wù)
雖然退休人員與用人單位一般被認(rèn)定為勞務(wù)關(guān)系,但為明確雙方的權(quán)利義務(wù),用人單位仍應(yīng)與退休人員簽訂書(shū)面的退休返聘協(xié)議,協(xié)議至少應(yīng)包括如下內(nèi)容:(1)雙方的主體情況及協(xié)議期限等;(2)退休人員的工作崗位、職責(zé)、時(shí)間、考勤標(biāo)準(zhǔn)、處罰等;(3)退休人員的勞務(wù)報(bào)酬、支付方式等;(4)協(xié)議的解除和終止的條件及方式。
3、加強(qiáng)日常管理,避免過(guò)錯(cuò)責(zé)任
由于退休人員大都年齡較大,若出現(xiàn)意外事故,則用人單位仍需在過(guò)錯(cuò)范圍內(nèi)承擔(dān)相應(yīng)的賠償責(zé)任,因此,用人單位應(yīng)加強(qiáng)對(duì)退休人員的安全管理,盡量避免在危險(xiǎn)崗位或區(qū)域使用退休人員,避免返聘行動(dòng)不便的退休人員,避免退休人員長(zhǎng)時(shí)間、超負(fù)荷工作,同時(shí),加強(qiáng)對(duì)退休人員活動(dòng)區(qū)域的安全維護(hù)工作,避免因工作場(chǎng)所地滑、墜落物等原因?qū)е峦诵萑藛T的人身?yè)p害。
4、購(gòu)買(mǎi)雇主責(zé)任險(xiǎn)或人身傷害意外保險(xiǎn)
用人單位可通過(guò)購(gòu)買(mǎi)雇主責(zé)任險(xiǎn)或人身傷害意外保險(xiǎn)的方式轉(zhuǎn)嫁雇主損害賠償?shù)娘L(fēng)險(xiǎn),避免向退休人員承擔(dān)高昂的賠償費(fèi)用。另外,我國(guó)部分地區(qū)已針對(duì)超過(guò)法定退休年齡從業(yè)人員制定了專(zhuān)門(mén)的從業(yè)傷害保險(xiǎn)規(guī)定,可按照相關(guān)規(guī)定購(gòu)買(mǎi)從業(yè)傷害保險(xiǎn)。
三、雙重勞動(dòng)關(guān)系
(一)雙重勞動(dòng)關(guān)系的概述
雙重勞動(dòng)關(guān)系下的用工,指同一勞動(dòng)者在同一時(shí)期與兩個(gè)不同的用人單位建立或形成均符合勞動(dòng)關(guān)系構(gòu)成要件的用工關(guān)系。
目前,我國(guó)《勞動(dòng)合同法》等相關(guān)法律法規(guī)并未禁止雙重勞動(dòng)關(guān)系的存在,甚至部分司法解釋、地方法規(guī)及政府規(guī)章對(duì)雙重勞動(dòng)關(guān)系予以書(shū)面認(rèn)可。如最高人民法院《關(guān)于審理勞動(dòng)爭(zhēng)議案件適用法律若干問(wèn)題的解釋
(三)》第八條規(guī)定:“企業(yè)停薪留職人員、未達(dá)到法定退休年齡的內(nèi)退人員、下崗待崗人員以及企業(yè)經(jīng)營(yíng)性停產(chǎn)放長(zhǎng)假人員,因與新的用人單位發(fā)生用工爭(zhēng)議,依法向人民法院提起訴訟的,人民法院應(yīng)當(dāng)按勞動(dòng)關(guān)系處理。”
(二)雙重勞動(dòng)關(guān)系下的用工風(fēng)險(xiǎn)
1、對(duì)前用人單位連帶賠償風(fēng)險(xiǎn)
根據(jù)我國(guó)勞動(dòng)人事相關(guān)法律法規(guī)的規(guī)定,先成立的勞動(dòng)關(guān)系優(yōu)先于后成立的勞動(dòng)關(guān)系,原用人單位有權(quán)要求勞動(dòng)者履行勞動(dòng)合同,不得對(duì)外兼職或建立新的勞動(dòng)關(guān)系,若企業(yè)招用與其他用人單位尚未解除或者終止勞動(dòng)合同的勞動(dòng)者,給原用人單位造成損失的,應(yīng)當(dāng)承擔(dān)連帶賠償責(zé)任。
2、工傷賠付的法律風(fēng)險(xiǎn)
一般而言,勞動(dòng)者已由原用人單位購(gòu)買(mǎi)了社會(huì)保險(xiǎn),隨著全國(guó)統(tǒng)一社會(huì)保障號(hào)的啟動(dòng),使得社會(huì)保險(xiǎn)無(wú)需也無(wú)法重復(fù)辦理,導(dǎo)致后建立勞動(dòng)關(guān)系的用人單位難以為勞動(dòng)者購(gòu)買(mǎi)保險(xiǎn)(尤其是工傷保險(xiǎn)),這樣一旦勞動(dòng)者在未繳納工傷保險(xiǎn)費(fèi)的用人單位發(fā)生工傷,就不能從工傷保險(xiǎn)基金處獲得工傷保險(xiǎn)賠償,或者說(shuō)發(fā)生工傷的用人單位就免不了本可以由工傷保險(xiǎn)基金承擔(dān)的相關(guān)賠償責(zé)任。
(三)雙重勞動(dòng)關(guān)系的用工風(fēng)險(xiǎn)緩釋措施
1、加強(qiáng)招聘錄用環(huán)節(jié)的審查
在招聘錄用新人員時(shí),(1)在錄用條件闡明:尚未與其他單位辦理勞動(dòng)關(guān)系解除/終止手續(xù)的情形屬于不符合錄用條件,用人單位可隨時(shí)在試用期內(nèi)解除勞動(dòng)合同;(2)在人員錄用面試過(guò)程中,應(yīng)詢(xún)問(wèn)對(duì)方是否與其他單位存在勞動(dòng)關(guān)系、是否還存在未了結(jié)的債權(quán)債務(wù)情況;(3)要求勞動(dòng)者正式入職前提交其與前用人單位解除/終止勞動(dòng)存在勞動(dòng)關(guān)系的證明材料,并進(jìn)一步電話核實(shí);(4)在員工手冊(cè)闡明:若與員工其他單位存在勞動(dòng)關(guān)系,則用人單位有權(quán)單方面解除勞動(dòng)合同。
2、堅(jiān)持簽訂書(shū)面勞動(dòng)合同和購(gòu)買(mǎi)社會(huì)保險(xiǎn)
針對(duì)已存在雙重勞動(dòng)關(guān)系的員工,用人單位應(yīng)與之簽訂書(shū)面勞動(dòng)合同,避免被勞動(dòng)者主張雙倍工資的風(fēng)險(xiǎn);用人單位應(yīng)為該部分員工購(gòu)買(mǎi)社會(huì)保險(xiǎn),尤其是工傷保險(xiǎn),避免因員工工傷導(dǎo)致承擔(dān)高昂的賠償責(zé)任。
3、逐漸減少使用存在雙重勞動(dòng)關(guān)系的職工
用人單位應(yīng)逐步減少存在雙重勞動(dòng)關(guān)系的職工量,盡量不在重要的技術(shù)崗位、管理崗位及涉密崗位等崗位上使用存在雙重勞動(dòng)關(guān)系的職工,盡量只在非全日制用工模式下使用存在雙重勞動(dòng)關(guān)系的人員,避免既是全日制用工又存在雙重勞動(dòng)關(guān)系的用工模式。

2003年春天,SARS病毒如洪水猛獸侵襲京城。為搶救生命和控制疫情,糖皮質(zhì)激素被大量用于非典緊急治療。諸多患者因此出現(xiàn)股骨頭壞死癥狀,以及肺部功能障礙和其他藥物副作用反應(yīng)。大部分人喪失勞動(dòng)能力,生活難以自理,嚴(yán)重者不得不更換股骨頭關(guān)節(jié)。
8年后,那場(chǎng)公共衛(wèi)生災(zāi)難不再被提起。眾多非典后遺癥患者獨(dú)自承受著身體和心靈不可愈合的創(chuàng)傷。他們被習(xí)慣性地遺忘了。因?yàn)檫z忘,人們甚至無(wú)法得知他們?cè)谠鯓营?dú)自面對(duì)著命運(yùn)。
武震:我想有個(gè)家
武震的家在北京市豐臺(tái)區(qū)劉莊子,靠近西南五環(huán),距離她接受康復(fù)治療的小湯山醫(yī)院有60多公里。
通常情況下,她會(huì)避開(kāi)周一的早高峰,選擇人相對(duì)少的時(shí)候去坐公交車(chē)。她家門(mén)口不遠(yuǎn)處有678路車(chē)站,坐上這輛車(chē)到正陽(yáng)大橋東,倒一趟617到天通苑,然后再換乘一次才能到北六環(huán)外的小湯山醫(yī)院。這個(gè)過(guò)程要消耗大約4個(gè)小時(shí)的時(shí)間。如果選擇坐地鐵,時(shí)間會(huì)少一些,但地鐵的上下臺(tái)階太多了,對(duì)于全身只有肘關(guān)節(jié)沒(méi)有壞死的武震來(lái)說(shuō),那些臺(tái)階顯得太困難了。
2003年4月,武震在北京大學(xué)人民醫(yī)院急診科實(shí)習(xí)時(shí)感染非典。同年10月被查出“雙股骨頭無(wú)菌性壞死”??克幬锖童燄B(yǎng)保守治療了幾年后,武震的左側(cè)股骨頭塌陷。她堅(jiān)持做了植骨手術(shù),但不幸失敗。這之后,她被迫放棄工作,治病成了生活的重心。她開(kāi)始長(zhǎng)期住在醫(yī)院里,重復(fù)枯燥乏味的康復(fù)訓(xùn)練。
盡管醫(yī)院的環(huán)境那么熟悉,但病患的身份卻太陌生。她有些不能接受這個(gè)現(xiàn)實(shí)。長(zhǎng)年困在醫(yī)院讓她覺(jué)得自己和社會(huì)完全脫節(jié)了,別人有的正常生活她都沒(méi)有。她不能再去爬山跑步,甚至連和男朋友一起逛街都得坐在輪椅上。這種落差帶來(lái)的焦慮使得他們的每一次見(jiàn)面都是在爭(zhēng)吵中度過(guò)的;再加上男方家人和朋友的勸阻,分手變成了一個(gè)定局。
武震說(shuō),提起這段感情,妹妹總勸她:“你也不能只怪別人沒(méi)有責(zé)任感,你那時(shí)總是對(duì)人家嚷,見(jiàn)了面就生氣,并且人家還可能要照顧你下半輩子的生活,誰(shuí)能愿意這樣老看著你啊?”當(dāng)被問(wèn)到現(xiàn)在還恨不恨前男友時(shí),武震說(shuō):“我已經(jīng)能夠理解他了。我們現(xiàn)在偶爾會(huì)發(fā)發(fā)短信互相問(wèn)候一下,就做普通朋友吧。我就只想著他曾經(jīng)帶給我的美好,這樣就可以了;但我還是希望自己能有一個(gè)家,能夠走入正常人的生活??”

方渤從今年7月開(kāi)始就幾乎都住在望京醫(yī)院。他說(shuō)往年住院基本都是冬天,那個(gè)時(shí)候醫(yī)院的床位不會(huì)太緊張,但是今年他的腿總是疼得厲害。
關(guān)節(jié)三科的醫(yī)護(hù)人員和患者們都已經(jīng)對(duì)他非常熟悉,他從家到醫(yī)院后,會(huì)在樓道里跟很多人打招呼,也可以把從家?guī)?lái)的菜放在醫(yī)生辦公室的冰箱里。
2003年他一家8口感染非典,出院時(shí)只剩下6人。兩個(gè)女兒皆因?yàn)榉堑浜筮z癥離婚。他的大女兒離婚后住在家里,小女兒無(wú)法承受喪母和婚姻破裂的打擊,嫁給了一個(gè)東北人,從此只有在母親忌日時(shí)才會(huì)回京。
確診患非典后遺癥之后,方渤開(kāi)始了漫長(zhǎng)的上訪之路。
他手里拿著許許多多自己搜集的資料和各個(gè)媒體對(duì)他的報(bào)道,輕車(chē)熟路地說(shuō)著他的質(zhì)疑和訴求。他說(shuō)他想復(fù)印自己的病歷,但被告知所有的非典病例都被封存了。因?yàn)橄胍玫綋嵝艚鸷透用鞔_規(guī)范的經(jīng)濟(jì)補(bǔ)償,他也試圖訴諸法律,但法院拒絕受理。為了求市里的領(lǐng)導(dǎo)解決問(wèn)題,他曾經(jīng)在市政府門(mén)前跪了近兩個(gè)小時(shí),那個(gè)時(shí)候他剛剛查出雙膝骨壞死不久。而因?yàn)檫@種行為,他被定性為“在上訪過(guò)程中有過(guò)激言行,擾亂上訪秩序”。后來(lái)再去上訪的時(shí)候,他就套著一個(gè)背心,上面寫(xiě)著:請(qǐng)關(guān)愛(ài)非典后遺癥患者。
他說(shuō):“我一直相信黨、相信國(guó)家、相信北京市政府能夠把我們的事處理好,但我們一直盼、一直盼,盼了八年,一個(gè)抗日戰(zhàn)爭(zhēng)的時(shí)間都快到了。每次得到的回答就是上面還在研究。一個(gè)問(wèn)題研究了八年??”
有一次,公安機(jī)關(guān)的工作人員問(wèn)他,你想干什么?他說(shuō):“我不想干什么,我就想我的問(wèn)題得到解決,能活的有點(diǎn)兒人樣,我就想為我的愛(ài)人討回一個(gè)說(shuō)法。她不明不白地被別人傳染,到死我連面都見(jiàn)不到?,F(xiàn)在連骨灰是不是我愛(ài)人的都是個(gè)疑問(wèn)。我女兒?jiǎn)栁摇@骨灰是我媽的嗎?’我只能告訴她,你該哭就哭吧,你在哭她的時(shí)候別人可能也在哭你媽呢??” 說(shuō)到這里,方渤的情緒有些失控。邊幻云一家:讓我做你的拐杖
林林和園園是大學(xué)同學(xué),那時(shí)他們的教室門(mén)對(duì)門(mén),他倆上課都坐第一排。林林無(wú)意間看到坐在對(duì)面教室里的園園,覺(jué)得這個(gè)姑娘很可愛(ài)。暗戀半年之后,林林終于在上大課的時(shí)候因?yàn)閹蛨@園占座而搭上了話,之后他們戀愛(ài)了。
當(dāng)時(shí),林林的同學(xué)都勸他別和園園在一起,因?yàn)閳@園的聽(tīng)覺(jué)有障礙,口齒不清。但林林沒(méi)覺(jué)得這是個(gè)問(wèn)題。
2003年4月,林林不幸感染非典。為了照顧他,媽媽邊幻云和女友園園也相繼被感染,病愈后他們又全都被查出股骨頭壞死。之后,邊幻云和丈夫離了婚,兩個(gè)孩子和她相依為命。
2004年,林林接受股骨頭置換手術(shù)后,在床上一躺就是三年。那段時(shí)間是與世隔絕的,他看不到未來(lái),無(wú)法自由活動(dòng),甚至整整一年都沒(méi)洗過(guò)澡。
因?yàn)閾?dān)心兒子的病情和將來(lái),邊幻云得了抑郁癥,精神幾乎崩潰。
那個(gè)時(shí)候似乎全是壞消息。2005年春節(jié)前的一天,園園和邊幻云去采購(gòu)年貨,他一人躺在家里,這時(shí)換防盜門(mén)的工人來(lái)了,沒(méi)有辦法,他就在地上爬著去開(kāi)了門(mén)。邊幻云回來(lái)后看到裝好的防盜門(mén),一家三口抱頭痛哭。
園園也想過(guò)要放棄,但是她記得他們剛在一起時(shí),自己很自卑,她去同仁醫(yī)院看耳神經(jīng),醫(yī)生講的話她聽(tīng)不見(jiàn)。醫(yī)生問(wèn)她有沒(méi)有家人,她說(shuō)都在昌平,趕不過(guò)來(lái);醫(yī)生問(wèn)她有沒(méi)有男朋友,她說(shuō)有,就打電話給林林。林林從西單打車(chē)趕到醫(yī)院。在那之后半年,園園才知道醫(yī)生對(duì)他說(shuō):“她年紀(jì)越大聽(tīng)力也會(huì)越差,也許老了就徹底聽(tīng)不見(jiàn)了。你要當(dāng)她的拐杖??”園園說(shuō):“現(xiàn)在你腿不能動(dòng),該我做你的拐杖了?!?/p>
2006年,林林的病情逐漸好轉(zhuǎn),他終于可以下地走動(dòng)了。他一直在想,什么時(shí)候才能陪園園好好逛逛商場(chǎng)。那年春節(jié)前,他和園園一起去采購(gòu)年貨,回家之后,腿疼了一個(gè)星期。
2007年,區(qū)里和殘聯(lián)把林林介紹到地稅去上班。同年9月26日,林林和園園領(lǐng)了結(jié)婚證。2008年5月10日,在眾多好心人的幫助下,這對(duì)歷經(jīng)磨難的情侶舉辦了他們的婚禮。那天,現(xiàn)場(chǎng)很多人都泣不成聲。園園說(shuō):“這個(gè)幸福是屬于我的嗎?”林林說(shuō):“是”。園園說(shuō):“但我覺(jué)得這太奢侈了。”
2009年9月26日,在他們領(lǐng)結(jié)婚證的2周年紀(jì)念日,林林和園園終于補(bǔ)上了自己的蜜月旅行。他們?nèi)チ艘淮魏D?,一?天。
去年,趕上北京兩區(qū)合并,林林又下崗了。不過(guò)好在不久之后他又被安排到街道辦事處上班。園園自非典之后血脂一直降不下來(lái),最近剛剛查出患了IgA腎炎。她沒(méi)有辦法從事高強(qiáng)度的工作。
今年,是他們攜手走過(guò)的第十年。
邊幻云希望政府能給兩個(gè)孩子安置穩(wěn)定的工作,能讓他們有合理的收入。她還希望社區(qū)醫(yī)院能對(duì)非典后遺癥患者開(kāi)放,這樣她就不必總是跑到很遠(yuǎn)的地方去看病了。
林林說(shuō)20多歲經(jīng)歷過(guò)這么多苦難,現(xiàn)在遇到什么事兒,想想那時(shí)候,真不算什么了。他只想踏踏實(shí)實(shí)地工作,有一份收入,能讓媽媽和媳婦過(guò)得好,全家人能開(kāi)開(kāi)心心地生活。
園園只希望能過(guò)正常人的日子,不要再遇到非典這么大的打擊了。她每天都會(huì)祈禱全家人健康、平安。

茹琴手里拿著工傷證,卻從沒(méi)有因此獲得人民醫(yī)院的一分錢(qián)賠償金。甚至連每年的醫(yī)藥費(fèi)報(bào)銷(xiāo)都被一拖再拖。非典時(shí)期,做為臨時(shí)工的她被當(dāng)做半個(gè)護(hù)士使用,確診非典后遺癥后,她被人民醫(yī)院無(wú)情拋棄。
心潔因非典離婚后和老母親住在地下室里,那里沒(méi)有手機(jī)信號(hào),用水和上廁所都很不方便,并且要爬很多樓梯,這對(duì)股骨頭壞死的她來(lái)說(shuō)是種折磨。
李書(shū)元從首鋼下崗后開(kāi)起了出租,運(yùn)營(yíng)途中被乘客傳染非典。確診非典后遺癥以后,他喪失勞動(dòng)能力,只能每天坐在沙發(fā)上。
張海英90年代末就開(kāi)始在北京打拼,她的檔案和工作關(guān)系全都在北京,但因?yàn)樗龥](méi)有北京戶(hù)口,衛(wèi)生局確認(rèn)的非典后遺癥免費(fèi)醫(yī)療名單中沒(méi)有她。北京目前有登記在冊(cè)的非典后遺癥患者約300人。長(zhǎng)期以來(lái),他們生活在疾病折磨和心理憂患中。民間調(diào)查顯示,他們之中的80%因此失去工作,6成以上家庭破裂。
幾年來(lái),北京市政府也做出了許多努力,包括定點(diǎn)免費(fèi)治療及進(jìn)行生活補(bǔ)償。2004年,國(guó)家衛(wèi)生部正式成立“非典”后遺癥專(zhuān)家組。目前,股骨頭壞死、肺纖維化及精神抑郁癥都被納入了非典后遺癥的免費(fèi)治療范圍,可以報(bào)銷(xiāo)之前發(fā)生的用于治療非典后遺癥的費(fèi)用,同時(shí)由紅十字會(huì)提供補(bǔ)助。除此之外,有工作單位的人每年可以得到4000元生活補(bǔ)助,沒(méi)有工作單位的每年8000。但這些錢(qián)對(duì)于他們來(lái)說(shuō)是杯水車(chē)薪。
時(shí)間好像已經(jīng)撫平了SARS在人們心中留下的傷痕,小湯山非典醫(yī)院也已雜草叢生,一片荒蕪。曾經(jīng)很多事情我們像暴風(fēng)驟雨般地去經(jīng)歷,然后又暴風(fēng)驟雨般地去遺忘。
在這里呈現(xiàn)的每一個(gè)凝固的瞬間,是希望能讓更多的人看到、了解并且關(guān)愛(ài)這個(gè)特殊的群體,是希望每一個(gè)因?yàn)槟菆?chǎng)公共衛(wèi)生災(zāi)難而生活在病痛折磨和心理憂患中的人感受到活著的尊嚴(yán)。希望這一次,它不僅僅是為了忘卻的紀(jì)念。

Over the past few years as First Lady, I have had the extraordinary privilege of traveling all across this everywhere I’ve gone, in the people I’ve met, and the stories I’ve heard, I have seen the very best of the American have seen it in the incredible kindness and warmth that people have shown me and my family, especially our ’ve seen it in teachers in a near-bankrupt school district who vowed to keep teaching without ’ve seen it in people who become heroes at a moment’s notice, diving into harm’s way to save others…flying across the country to put out a fire…driving for hours to bail out a flooded I’ve seen it in our men and women in uniform and our proud military families…in wounded warriors who tell me they’re not just going to walk again, they’re going to run, and they’re going to run marathons…in the young man blinded by a bomb in Afghanistan who said, simply, “…I’d give my eyes 100 times again to have the chance to do what I have done and what I can still do.”
Every day, the people I meet inspire me…every day, they make me proud…every day they remind me how blessed we are to live in the greatest nation on as your First Lady is an honor and a privilege…but back when we first came together four years ago, I still had some concerns about this journey we’d I believed deeply in my husband’s vision for this country…and I was certain he would make an extraordinary President…like any mother, I was worried about what it would mean for our girls if he got that would we keep them grounded under the glare of the national spotlight? How would they feel being uprooted from their school, their friends, and the only home they’d ever known? Our life before moving to Washington was filled with simple joys…Saturdays at soccer games, Sundays at grandma’s house…and a date night for Barack and me was either dinner or a movie, because as an exhausted mom, I couldn’t stay awake for the truth is, I loved the life we had built for our girls…I deeply loved the man I had built that life with…and I didn’t want that to change if he became loved Barack just the way he see, even though back then Barack was a Senator and a presidential candidate…to me, he was still the guy who’d picked me up for our dates in a car that was so rusted out, I could actually see the pavement going by through a hole in the passenger side door…h(huán)e was the guy whose proudest possession was a coffee table he’d found in a dumpster, and whose only pair of decent shoes was half a size too when Barack started telling me about his family – that’s when I knew I had found a kindred spirit, someone whose values and upbringing were so much like see, Barack and I were both raised by families who didn’t have much in the way of money or material possessions but who had given us something far more valuable – their unconditional love, their unflinching sacrifice, and the chance to go places they had never imagined for father was a pump operator at the city water plant, and he was diagnosed with Multiple Sclerosis when my brother and I were even as a kid, I knew there were plenty of days when he was in pain…I knew there were plenty of mornings when it was a struggle for him to simply get out of every morning, I watched my father wake up with a smile, grab his walker, prop himself up against the bathroom sink, and slowly shave and button his when he returned home after a long day’s work, my brother and I would stand at the top of the stairs to our little apartment, patiently waiting to greet him…watching as he reached down to lift one leg, and then the other, to slowly climb his way into our despite these challenges, my dad hardly ever missed a day of work…h(huán)e and my mom were determined to give me and my brother the kind of education they could only dream when my brother and I finally made it to college, nearly all of our tuition came from student loans and my dad still had to pay a tiny portion of that tuition every semester, he was determined to pay that bill right on time, even taking out loans when he fell was so proud to be sending his kids to college…and he made sure we never missed a registration deadline because his check was see, for my dad, that’s what it meant to be a so many of us, that was the measure of his success in life – being able to earn a decent living that allowed him to support his as I got to know Barack, I realized that even though he’d grown up all the way across the country, he’d been brought up just like was raised by a single mother who struggled to pay the bills, and by grandparents who stepped in when she needed ’s grandmother started out as a secretary at a community bank…and she moved quickly up the ranks…but like so many women, she hit a glass for years, men no more qualified than she was – men she had actually trained – were promoted up the ladder ahead of her, earning more and more money while Barack’s family continued to scrape day after day, she kept on waking up at dawn to catch the bus…arriving at work before anyone else…giving her best without complaint or she would often tell Barack, “So long as you kids do well, Bar, that’s all that really matters.”
Like so many American families, our families weren’t asking for didn’t begrudge anyone else’s success or care that others had much more than they did...in fact, they admired simply believed in that fundamental American promise that, even if you don’t start out with much, if you work hard and do what you’re supposed to do, then you should be able to build a decent life for yourself and an even better life for your kids and ’s how they raised us…that’s what we learned from their learned about dignity and decency – that how hard you work matters more than how much you make…that helping others means more than just getting ahead learned about honesty and integrity – that the truth matters…that you don’t take shortcuts or play by your own set of rules…and success doesn’t count unless you earn it fair and learned about gratitude and humility – that so many people had a hand in our success, from the teachers who inspired us to the janitors who kept our school clean…and we were taught to value everyone’s contribution and treat everyone with are the values Barack and I – and so many of you – are trying to pass on to our own ’s who we standing before you four years ago, I knew that I didn’t want any of that to change if Barack became , today, after so many struggles and triumphs and moments that have tested my husband in ways I never could have imagined, I have seen firsthand that being president doesn’t change who you are – it reveals who you see, I’ve gotten to see up close and personal what being president really looks I’ve seen how the issues that come across a President’s desk are always the hard ones – the problems where no amount of data or numbers will get you to the right answer…the judgment calls where the stakes are so high, and there is no margin for as President, you can get all kinds of advice from all kinds of at the end of the day, when it comes time to make that decision, as President, all you have to guide you are your values, and your vision, and the life experiences that make you who you when it comes to rebuilding our economy, Barack is thinking about folks like my dad and like his ’s thinking about the pride that comes from a hard day’s ’s why he signed the Lilly Ledbetter Fair Pay Act to help women get equal pay for equal ’s why he cut taxes for working families and small businesses and fought to get the auto industry back on its ’s how he brought our economy from the brink of collapse to creating jobs again – jobs you can raise a family on, good jobs right here in the United States of it comes to the health of our families, Barack refused to listen to all those folks who told him to leave health reform for another day, another didn’t care whether it was the easy thing to do politically – that’s not how he was raised – he cared that it was the right thing to did it because he believes that here in America, our grandparents should be able to afford their medicine…our kids should be able to see a doctor when they’re sick…and no one in this country should ever go broke because of an accident or he believes that women are more than capable of making our own choices about our bodies and our health care…that’s what my husband stands it comes to giving our kids the education they deserve, Barack knows that like me and like so many of you, he never could’ve attended college without financial believe it or not, when we were first married, our combined monthly student loan bills were actually higher than our were so young, so in love, and so in ’s why Barack has fought so hard to increase student aid and keep interest rates down, because he wants every young person to fulfill their promise and be able to attend college without a mountain of in the end, for Barack, these issues aren’t political – they’re Barack knows what it means when a family knows what it means to want something more for your kids and knows the American Dream because he’s lived it…and he wants everyone in this country to have that same opportunity, no matter who we are, or where we’re from, or what we look like, or who we he believes that when you’ve worked hard, and done well, and walked through that doorway of opportunity…you do not slam it shut behind you…you reach back, and you give other folks the same chances that helped you when people ask me whether being in the White House has changed my husband, I can honestly say that when it comes to his character, and his convictions, and his heart, Barack Obama is still the same man I fell in love with all those years ’s the same man who started his career by turning down high paying jobs and instead working in struggling neighborhoods where a steel plant had shut down, fighting to rebuild those communities and get folks back to work…because for Barack, success isn’t about how much money you make, it’s about the difference you make in people’s ’s the same man who, when our girls were first born, would anxiously check their cribs every few minutes to ensure they were still breathing, proudly showing them off to everyone we ’s the man who sits down with me and our girls for dinner nearly every night, patiently answering their questions about issues in the news, and strategizing about middle school ’s the man I see in those quiet moments late at night, hunched over his desk, poring over the letters people have sent letter from the father struggling to pay his bills…from the woman dying of cancer whose insurance company won’t cover her care…from the young person with so much promise but so few see the concern in his eyes...and I hear the determination in his voice as he tells me, “You won’t believe what these folks are going through, Michelle…it’s not ’ve got to keep working to fix ’ve got so much more to do.”
I see how those stories – our collection of struggles and hopes and dreams – I see how that’s
what drives Barack Obama every single I didn’t think it was possible, but today, I love my husband even more than I did four years ago…even more than I did 23 years ago, when we first love that he’s never forgotten how he love that we can trust Barack to do what he says he’s going to do, even when it’s hard – especially when it’s love that for Barack, there is no such thing as “us” and “them” – he doesn’t care whether you’re a Democrat, a Republican, or none of the above…h(huán)e knows that we all love our country…and he’s always ready to listen to good ideas…h(huán)e’s always looking for the very best in everyone he I love that even in the toughest moments, when we’re all sweating it – when we’re worried that the bill won’t pass, and it seems like all is lost – Barack never lets himself get distracted by the chatter and the like his grandmother, he just keeps getting up and moving forward…with patience and wisdom, and courage and he reminds me that we are playing a long game here…and that change is hard, and change is slow, and it never happens all at eventually we get there, we always get there because of folks like my Dad…folks like Barack’s grandmother…men and women who said to themselves, “I may not have a chance to fulfill my dreams, but maybe my children will…maybe my grandchildren will.”
So many of us stand here tonight because of their sacrifice, and longing, and steadfast love…because time and again, they swallowed their fears and doubts and did what was today, when the challenges we face start to seem overwhelming – or even impossible – let us never forget that doing the impossible is the history of this nation…it’s who we are as Americans…it’s how this country was if our parents and grandparents could toil and struggle for us…if they could raise beams of steel to the sky, send a man to the moon, and connect the world with the touch of a button…then surely we can keep on sacrificing and building for our own kids and if so many brave men and women could wear our country’s uniform and sacrifice their lives for our most fundamental rights…then surely we can do our part as citizens of this great democracy to exercise those rights…surely, we can get to the polls and make our voices heard on Election farmers and blacksmiths could win independence from an empire…if immigrants could leave behind everything they knew for a better life on our shores…if women could be dragged to jail for seeking the vote…if a generation could defeat a depression, and define greatness for all time…if a young preacher could lift us to the mountaintop with his righteous dream…and if proud Americans can be who they are and boldly stand at the altar with who they love…then surely, surely we can give everyone in this country a fair chance at that great American in the end, more than anything else, that is the story of this country – the story of unwavering hope grounded in unyielding is what has made my story, and Barack’s story, and so many other American stories I say all of this tonight not just as First Lady…and not just as a see, at the end of the day, my most important title is still “mom-in-chief.” My daughters are still the heart of my heart and the center of my today, I have none of those worries from four years ago about whether Barack and I were doing what’s best for our today, I know from experience that if I truly want to leave a better world for my daughters, and all our sons and daughters…if we want to give all our children a foundation for their dreams and opportunities worthy of their promise…if we want to give them that sense of limitless possibility – that belief that here in America, there is always something better out there if you’re willing to work for it…then we must work like never before…and we must once again come together and stand together for the man we can trust to keep moving this great country forward…my husband, our President, President Barack you, God bless you, and God bless America
